The Manual of Guidance was first published in 1992 following the 1990 publication of the report of the inter agency Working Group on Pre Trial Issues (WGPTI). The Manual contains guidelines for the preparation of case files, their content, format and time guidelines for submission. Since that time, a number of amendments have been made to the Manual principally in response to changes in legislation and to address concerns about administrative burdens on the police.

In this revision, changes to the Manual have been made to reflect the demands of the Narey case progression arrangements which are being implemented throughout England and Wales from 1 November 1999, and the need to reduce the time taken to progress youth offenders through the criminal justice system. In addition, this revision incorporates other changes which have been made and circulated since the last full edition was issued in October 1997.

Narey Case Progression Arrangements

New arrangements with respect to case file preparation have been developed and incorporated in this Manual to support the Narey case progression arrangements. Case file categories have been introduced for early first hearings (expedited files) and early administrative hearings (remand files). Remand files in this context may relate to cases where the defendant is bailed as well as cases where a remand in custody is sought.

Time guidelines

With the introduction of section 46 of the Crime and Disorder Act 1998 and other measures aimed at reducing delay in the criminal justice system, some of the time guidelines previously included in the Manual are no longer relevant and have been omitted. These have been replaced by local agreements and protocols between the police, CPS and the courts. Users of the Manual are reminded that the time guidelines still included in the document should be regarded as maxima. Every effort must be made to comply with them, and where possible, improve on them, although it is acknowledged that the time guidelines may have to be exceeded in large or complex cases. The targets set by Government for reducing the time taken to process cases involving persistent young offenders, together with forthcoming statutory time limits, make it particularly important to improve on the time taken in these cases wherever possible.
